Title & Proof of Ownership

All motor vehicles, motorcycles, trailers, ORVs, and watercraft must be titled unless exempt. Vehicles/watercraft exempt from registration, motor-driven cycles, ORVs purchased before 2010, snowmobiles, and special machinery are titled at owner's option.

Application for Title

Application for Certificate of Title (Form 205) or Application for Certificate of Watercraft Title (Form 38529) may be made to any BMV Branch Location. If the applicant does not have a record with the BMV, proof of SSN/EIN and Indiana residency must be presented.

Fee payable to the Indiana BMV. Credit/debit cards incur a transaction fee. Allow 21 days for processing. Speed titles available on qualifying transactions. Title may be issued in paper or electronic form beginning July 1, 2025.

Manufactured Homes

Manufactured homes must be titled unless attached to real estate by a permanent foundation. One title is issued regardless of the number of units. To transfer to real estate, an Affidavit of Transfer to Real Estate Checklist must be submitted with Affidavit of Transfer to Real Estate (51408), proof of ownership, and a $15.00 ATRE fee.

Electronic Signatures

Electronic signatures created using an electronic signature pad or an electronic signature service are accepted on all documentation except for MCOs/MSOs and titles. Special circumstances apply for odometer disclosure statements and powers of attorney.

U.S. Government Certificate to Obtain Title to a Vehicle (SF97-1).

Foreign Vehicles

Foreign ownership documents plus a U.S. Customs and Border Patrol Entry Form (CBP 7501 or equivalent DOD form for military), NHTSA HS-7, and EPA 3520-1. Documents in a foreign language must be accompanied by a translation on letterhead from a government entity, accredited educational institution, or translation agency.

Note: A bill of sale, dealer's invoice, purchase order, or sales contract is required. Surrender of proof of ownership is required. Indiana provides data to and inquiries NMVTIS prior to issuing titles.

Insufficient Evidence of Ownership

If proof of ownership for a vehicle, watercraft, or manufactured home with an average/clean retail value of $5,000 or less is unavailable, a title may be applied for by submitting an Affidavit of Ownership for a Vehicle (23037) with paperwork shown on the Affidavit of Ownership Checklist; otherwise, a court order is required.

Special Titles & Title Brands

No special titles are issued in Indiana. Brands are shown on the face of the Indiana title. Out-of-state brands are carried forward. Vehicles designated as Junk, Dismantled, Scrap, Destroyed, or similar in another state may not be titled in Indiana.

Salvage Vehicle

A motor vehicle manufactured within the last seven model years that an insurer has determined economically impractical to repair, or that has sustained damage exceeding 70% of fair market value, or that has sustained flood damage. The insurer must apply for a salvage title within 45 days after receipt of title. A $4.00 salvage title fee applies. A Certificate of Salvage Title will be issued.

Rebuilt Salvage Vehicle

To request a rebuilt title, a salvage restoration title must be applied for and the vehicle must be inspected by the Indiana State Police. Submit Affidavit of Restoration for a Salvage Motor Vehicle (44606) signed by the restorer and police officer, application for title, certificate of salvage title, proof of ownership for each major component part, and a $15.00 title fee. Title is issued with "Rebuilt Vehicle" or "Rebuilt Flood Damaged Vehicle."

Junk Vehicle

Prior to sale, transfer, or disposal, a Certificate of Authority (Form 55018) must be submitted with proof of ownership and a $4.00 fee. May be submitted online. An owner may also surrender the title to a salvage recycler to dispose of a vehicle without applying for a Certificate of Authority — vehicle will be noted as "junk" in BMV records.

Duplicate / Amended Title

If original title has been lost, mutilated, destroyed, or becomes illegible, a title will be issued with "Duplicate." An amended title is issued if information needs to be changed. Use Form 205 (or 38529 for watercraft). Valid photo ID required. Fee $15.00. Speed title may be available for additional $25.00. Duplicate titles may be applied for online.

Odometer Disclosure

Required upon transfer of ownership. Vehicles with a model year of 2010 or older, trailers and vehicles without odometer devices, and trucks over 16,000 lbs. GVWR are exempt. Form 43230 is required if the odometer statement is not completed on the title or MCO.

VIN Inspection

A Physical Inspection of a Vehicle or Watercraft (Form 39530) is required on all motor vehicles not previously titled in Indiana or when an Indiana dealer does not submit a title or MCO as the ownership document. Trailers and semitrailers are exempt. Inspections may be performed by designated dealers, Indiana military police, police officers, or designated BMV employees.

Lien Law

Lienholder information must be shown on the application for title. For a lien addition only, the title need not be assigned; however, all owners must sign the title application. Written permission from the primary lienholder is required to add a second lienholder. Lien is perfected as of the date of delivery.

Lien Expiration

Liens do not expire. Liens are valid until evidence of satisfaction is submitted.

Assignment of Lien

An assignment document from the original lienholder indicating the assignment of the lien, or a properly executed Indiana title indicating the assignment of the lienholder's interest, is required. The owner's signature is required for an assignment.

Responsible Party for Filing

The dealer is responsible for entering lien information on the application for title. The lienholder is responsible for filing the lien on casual sales.

UCC Filings

Liens on non-titled vehicles may be recorded through the Secretary of State, Uniform Commercial Code, 317.234.9768, [email protected]. Online filing is available.

Mechanic's Lien

If a vehicle was left in the custody of a person engaged in the business of storing, furnishing supplies, providing towing services, or repairing vehicles, a Labor, Materials, Storage or Repair Work Mechanic's Lien Title Application Checklist must be completed. A Mechanic's Lien Bill of Sale (Form 23104) must be given to the purchaser with a certificate or affidavit of publication from the newspaper verifying the vehicle was advertised for sale at public auction.

Release of Lien

The lienholder must execute the lien release section on the title and deliver to the owner within 10 business days after satisfaction to avoid penalty. If the lienholder is an individual, an Affidavit (Form 37964) may be used. E-liens must be released electronically within 10 business days after satisfaction. When the last lien is satisfied, a clear title is issued to the owner.

Note: Title is not required if the application is accompanied by a written statement on lienholder's letterhead identifying the VIN and stating the lien has been satisfied.

E-Lien System

Financial institutions and other lenders who conduct at least 12 transactions per year are required to use the e-lien system. An Indiana Electronic Lien and Title Participating Lender Application is used to enroll or modify an existing account in the ELT Program and must be submitted to a BMV-approved ELT Service Provider. Title applications must include the ELT ID number or title will be printed and mailed to the lienholder. Paper titles may be requested. Contact the ELT Helpdesk for further information.

Transfer of Title

Transfer is accomplished by assignment of title. Seller must deliver the registration and proof of transfer to the BMV within 30 days of transfer.

Transfer Deadlines & Penalties

  • Dealers: Must deliver title to purchaser within 31 days of sale to avoid civil penalty ($100 first violation, $250 second, $500 subsequent violations per calendar year).
  • Purchasers: Must apply for title within 45 days of date of sale or transfer to avoid a $30.00 administrative penalty ($10.00 for salvage titles).
  • New residents: Must title vehicles within 60 days of establishing residency to avoid an administrative penalty.
  • TOD beneficiary: Must apply for title within 60 days of acquiring the vehicle.

Add/Remove a Party

Same procedures as any other transfer. If there is a lien on the vehicle, the lienholder must approve, in writing, any changes in ownership. An amended registration must also be issued to reflect the new owners.

Damage Disclosure Statement

A person may not sell, exchange, or transfer a rebuilt vehicle without disclosing in writing to the purchaser prior to sale. Purchaser must sign a Salvage or Rebuilt Vehicle Disclosure (Form 55974). Any damage to a new motor vehicle exceeding 4.0% of the MSRP must be disclosed by a new motor vehicle dealer in writing prior to delivery.

Joint Ownership

Names are joined by the conjunction "and." All signatures are required to transfer ownership.

Notarization

Not required for title transfer in Indiana.

Transfer Upon Death

If joint owners are husband and wife and one is deceased, the surviving spouse is entitled to the vehicle upon presentation of proof of death. To transfer a title upon death of an owner other than husband and wife, a copy of the will, letters of administration/testamentary, guardianship papers, or a court order must accompany the title.

To transfer a vehicle for an estate whose gross value does not exceed $100,000 and no application or petition for the appointment of a personal representative is pending or has been granted, an Affidavit for Transfer of Certificate of Title for a Vehicle/Watercraft Without Administration (Form 18733) must be submitted with a copy of the death certificate.

Transfer on Death (TOD)

A TOD beneficiary may be added to an Indiana title. The title will print with a statement similar to "(Owner) transfers on death to (TOD Beneficiary)." The owner(s) must sign and date the TOD signature line on the face of the title. Upon death of the owner, the TOD beneficiary is entitled to the vehicle upon presentation of the title and proof of transferor's death. Application for title must be made within 60 days of acquiring the vehicle.

Power of Attorney

A notarized Limited Power of Attorney – Vehicle and Watercraft Transactions (Form 1940) may be used to appoint an agent to act on behalf of the owner. Two parties may be placed on the POA.

Limited Assignment Space

The Indiana title has one assignment plus three reassignment areas on titles issued after July 1, 1990. No additional assignments are allowed. A Reassignment of a Vehicle by a Registered Dealer (Form 20070) may be used by a registered dealer on a title that does not have three dealer reassignments.

Repossession

Upon default in the terms of a security agreement, the secured party may take possession of the vehicle without judicial process, if it proceeds without a breach of the peace. A primary lienholder may repossess a vehicle without a lien release from any other recorded lienholders; however, subsequent lienholder(s) must have a lien release from the first lienholder to repossess the vehicle.

Requirements

  • Repossession must be made from the last owner shown on the BMV's records
  • The lienholder may not sell a repossessed vehicle until after obtaining a title in their name
  • Submit the title with the recorded lien (not released), an application for title, a Certificate of Repossession (Form 39738), and any other required documents
  • A Manufactured (Mobile) Home Permit (Form 7878) certified by a County Treasurer is required to transfer a manufactured home

Out-of-State Title Available

If the out-of-state title is available, the lienholder may apply for title as above.

Out-of-State Title Unavailable

If the out-of-state title is not available or the previous state did not issue a title, the lienholder must provide verification of lien from the current state of title. If title is unavailable, applicant must present proof of lien, a UCC filing, or court order.

Registration

All motor vehicles operated on Indiana roads must be registered. Titling is a prerequisite to registration. New license plates are issued every seven years. Plate remains with the owner and may be transferred to another vehicle.

Exempt from Registration

Vehicles/watercraft exempt from registration, motor-driven cycles, ORVs purchased before 2010, snowmobiles, and special machinery are titled at owner's option but are not required to be registered for road use.

Application for Registration

Registration may be made at any BMV Branch Location. If the applicant does not have a record with the BMV, proof of SSN/EIN and Indiana residency must be presented. Registration must be carried in the vehicle.

Renewal

Renewal notices are sent to owners prior to registration expiration. Renewal may be made by phone (888.692.6841), by mail, online with a myBMV account or without an account, at BMV Connect Kiosks, or at any BMV Branch Location. Credit/debit cards incur a transaction fee.

Delinquent Registration Penalty

  • $15.00 administrative penalty when a vehicle/watercraft is not registered within 45 days of becoming subject to registration
  • $15.00 penalty for late renewal; or 10% of amount due for IRP vehicles
  • New residents must register within 60 days of establishing residency to avoid an administrative penalty of $15.00
  • Active military personnel are exempt from the delinquent registration penalty for late renewal

Planned Non-Operation

An Affidavit of Nonuse (56164) may be completed in lieu of registration for a vehicle that will not be used on an Indiana road for at least 90 consecutive days. The affidavit must be submitted within 45 days after purchase date or prior to the expiration date of the existing registration.

Plates

One plate issued. Plate remains with owner and may be transferred to another vehicle. Personalized plates: $45.00 in addition to applicable registration fees and taxes.

Plate Transfer

Fee: $9.50, plus any additional excise taxes owed on the vehicle to which the registration is transferred. Passenger, truck 11,000 lbs. or less, motorcycle, and In God We Trust plates may be transferred online.

Dealer / Manufacturer Plates

Issued through the Secretary of State. First two dealer plates: $40.00; motorcycle dealer: $15.00; watercraft dealer: $10.00; R&D: $20.00. Additional $5.00 service charge per set.

Nonresident Plates

Not required to surrender plates from previous state when applying for Indiana registration.

Military Registration

Active military personnel are exempt from the delinquent registration penalty for late registration renewal.

Gold Star Family, Disabled Hoosier Veteran, and Ex-POW plates are issued exempt from registration fees. A Certification of Eligibility for Veteran License Plates (32584) must be completed for Disabled Hoosier Veteran, Purple Heart, or Ex-POW plates. An Affidavit for Gold Star Family License Plate (54181) or DD1300 Form is required for Gold Star Family plates.

Taxes

Sales / Use Tax

7.0% of the purchase price

Collected on the sale or transfer of motor vehicles and watercraft. Credit is allowed for trade-in of like-kind vehicles and for taxes paid to another state.

Tax Collection

Certification indicating sales and use tax has been paid is required; otherwise, tax must be paid to the BMV. A Certificate of Gross Retail or Use Tax Paid (ST-108) is used by dealers to indicate the amount of tax collected. A Certificate of Sales Tax Paid or Exemption for Auctions (ST-108A) is required for vehicles/watercraft sold by an auction not acting as a licensed dealer.

Trade-In Credit Allowance (Like-Kind Vehicles)

In Indiana, "credit allowed for trade-in of like-kind vehicles" means that you can subtract the value of your trade-in vehicle from the taxable purchase price of your new vehicle, provided both units belong to the identical category of property. Under the Indiana Department of Revenue rules, this lowers the total amount subject to the state's 7% sales tax.

The Core Requirements

To legally qualify for this sales tax credit, the transaction must meet three major criteria established by the Indiana Administrative Code:

  1. Identical Vehicle Types: You must swap a motor vehicle for a motor vehicle, or a trailer for a trailer. For instance, trading a car for a truck qualifies, but trading a car for a pull-behind camper trailer does not.
  2. Ownership & Title: The vehicle being traded in must be legally owned and titled directly in the name of the customer making the new purchase.
  3. Simultaneous Transaction: The trade-in and the new purchase must happen at the same time with the same dealer as a single exchange. Selling your car independently to one business and buying a vehicle later from another will disqualify you from the tax credit.

Note: The state makes one notable exception to the trailer rule. Trading a motorized recreational vehicle (RV) for a non-motorized towable RV is considered like-kind.

Tax Exemptions

  • New residents: Vehicles previously titled and licensed in another state by a bona fide resident are exempt (complete New Resident Statement on ST-108E)
  • Family transfers: Adding/removing a spouse, child, grandparent, parent, or sibling
  • Government & nonprofits: Vehicles purchased by state/federal governmental units or nonprofit organizations
  • Gifts: Vehicles received as a gift
  • For-hire transportation: Vehicles, trailers, or watercraft predominantly used for hire in public transportation
  • Interstate commerce: Vehicles sold in interstate commerce delivered to a point outside Indiana
  • Nonresidents: Purchasing vehicles to be titled in another state within 30 days — subject to tax at the rate imposed by the other state (RVs and cargo trailers exempt with reciprocity)

If an exemption is claimed, a Certificate of Gross Retail or Use Tax Exemption (ST-108E), Affidavit of Exemption by a Nonresident (ST-137RV), or Certificate of Exemption from Retail Sales Tax on Aircraft Purchases (ST-108AIR) is required.

Manufactured Homes

Sales tax is collected on 65% of the purchase price of a manufactured home designed to be used as a residential dwelling (not to exceed two families). A Certification of Sales of Manufactured Homes (ST-108MH) must be sent to the DOR within 30 days of sale. Used manufactured homes are exempt.

Remote Sellers

Remote sellers with sales exceeding $100,000 to Indiana residents in the current or preceding calendar year must register with the Indiana DOR and collect and remit Indiana sales tax.

Excise Tax

Vehicle Excise Tax

Required annually upon registration of a motor vehicle, motorcycle, motor-driven cycle, trailer (3,001–9,000 lbs DGW), truck (11,000 lbs or less DGW), mini truck, military vehicle, recreational vehicle, truck camper, or watercraft in lieu of ad valorem property tax.

Tax amount is based on either the value and age of the vehicle/watercraft or on a flat rate. Vehicle owners living in certain counties and municipalities will also pay a county and municipal vehicle excise tax or wheel tax.

Excise Tax Exemptions

  • Vehicles/watercraft exempt from registration fees
  • Trailers with a declared GVW of 3,000 lbs or less
  • Mobile homes
  • Watercraft used in the production of income or used commercially
  • Vehicles sold to an exempt organization, official vehicles, school buses, and funeral vehicles

Commercial Vehicle Excise Tax (CVET)

Imposed on trucks or tractors with a declared gross weight of more than 11,000 lbs, trailers with a declared gross weight of more than 9,000 lbs, and semitrailers. Owners of commercial vehicles paying an apportioned registration under IRP pay an apportioned excise tax. Farm trucks, farm trailers/semitrailers, and tractors are assessed 50% of the amount.

Excise Tax Credits & Refunds

An excise tax credit/refund is available if vehicle/watercraft is sold, destroyed, otherwise disposed of, or registered in another state. Submit an Application for Vehicle Excise Tax Credit/Refund (55296) or Application for Boat Excise Tax Credit/Refund (23389) with supporting documentation. Refund must be at least $4.00 to receive a refund check. A $3.00 processing fee is assessed.

Other Taxes & Fees

Auto Rental Excise Tax

A credit against the vehicle excise tax owed for passenger motor vehicles or light trucks equal to the lesser of the total vehicle excise tax due or the total auto rental excise tax collected. An Auto Rental Excise Tax Credit Affidavit (47353) must be submitted.

Heavy Equipment Rental Excise Tax

A 2.25% tax is imposed on the gross retail income received from the rental of heavy rental equipment from an Indiana retail merchant.

Vehicle Sharing Excise Tax

A 2.0% tax is imposed on the gross retail income received from the sharing of passenger motor vehicles and trucks in Indiana for periods of less than 30 days. Trucks over 11,000 lbs declared gross weight are exempt.

Heavy Vehicle Use Tax

A copy of Heavy Highway Vehicle Use Tax Return (Form 2290) is required for trucks, for-hire buses, and semi-tractors with a GVW of 55,000 lbs or more prior to registration. An Exemption from Providing Proof of Completed IRS Form 2290 (56500) must be submitted if exempt.

  • Transportation Infrastructure Improvement Fee (TIIF): $15.00 annually on all motor vehicle registrations, except trailers, semitrailers, nonmotive recreational vehicles, special machinery, military vehicles, collector vehicles, motor-driven cycles, and trucks/tractors/for-hire buses with DGW over 26,000 lbs.
  • Hybrid Vehicle Supplemental Fee: $77.00 annually in addition to registration fees.
  • Electric Vehicle Supplemental Fee: $230.00 annually in addition to registration fees.
  • Farm Vehicles: Registered at 50% of the fees listed below (except recovery vehicles).

New license plates are issued every seven years. Partial-year registration is available for trailers with DGW over 9,000 lbs and trucks/tractors/for-hire buses with DGW over 11,000 lbs. Credit/debit cards incur a transaction fee at BMV branches.

Watercraft Registration

When a boat is registered for the first time in Indiana or changes ownership, the fee is the sum of a length-based fee plus an excise class fee. Renewal fees are based on excise class only. Watercraft values are based on MSRP when new.

Commercial vessels are subject to tonnage tax if registered at an Indiana port on May 1 of that year. An Application for Boat Excise Tax Credit/Refund (23389) may be submitted if the watercraft is sold, destroyed, or registered in another state.

Personalized Plates

$45.00 in addition to all applicable registration fees and taxes. Plates may be transferred to another vehicle.

Plate Transfer

$9.50, plus any additional excise taxes owed on the vehicle to which the registration is transferred. Passenger, truck (11,000 lbs or less), motorcycle, and In God We Trust plates may be transferred online.

Credits & Refunds

Unused registration fees may be transferred to another vehicle. Excise tax credit/refund available if vehicle is sold, destroyed, or registered in another state. Form 55296 (vehicles) or 23389 (boats). Minimum $4.00 refund; $3.00 processing fee.

Dealer & Manufacturer Plates

Issued through the Secretary of State. May be used in the usual operation of the business and movement of inventory. Dealer/manufacturer and bona fide employees may use for personal use.

General Information

Lease Information

Same forms, procedures, and fees apply to leased vehicles as privately-owned vehicles. A Statement of Existing Lease Agreement (Form 12787) is required to title/register all leased motor vehicles. Title is issued in the name of the lessor. Registration is issued in the name of the lessee. The vehicle must be registered in the county of the lessee's legal residence.

New motor vehicles acquired for rental or leasing by a rental company are exempt from state sales tax. This exemption does not apply to vehicles purchased for sharing through a peer-to-peer vehicle sharing program.

The lease of any motor vehicle or trailer is subject to sales or use tax, unless exempt. The lessor is responsible for the collection and remittance of tax on the lease and must register with the Indiana DOR. Credit is allowed for a like-kind trade-in titled in the customer's name and for state sales or use tax paid to another state.

Rental Vehicles

The rental of passenger motor vehicles, trucks, and watercraft is subject to Indiana sales tax. A 4.0% Auto Rental Excise Tax is imposed on the gross retail income received from the rental of passenger motor vehicles and trucks for periods of less than 30 days. Marion County imposes a 6.0% supplemental auto rental excise tax.

Trucks exceeding 11,000 lbs DGW, trailers, and peer-to-peer vehicle sharing vehicles are exempt from auto rental excise tax. Rental companies are entitled to a credit against the vehicle excise tax owed. An Auto Rental Excise Tax Credit Affidavit (47353) must be submitted with every registration application where credit is claimed.

Recovery vehicles with GVWR over 16,000 lbs require $500,000/$1,000,000/$100,000 or $750,000 CSL; $100,000/$300,000/$50,000 or $300,000 CSL if GVWR is 16,000 lbs or less. Proof of insurance is required at time of registration and must be carried in the vehicle. Does not apply to ORVs, snowmobiles, motor-driven cycles, or electric foot scooters.

Motor Vehicle Safety Inspection

Not required in Indiana. There is no state-mandated safety inspection program.

Emissions Inspection

Not required in Indiana. There is no state-mandated emissions testing program.

Records

Vehicle records are maintained by the Indiana Bureau of Motor Vehicles. Record requests must comply with the Driver Privacy Protection Act (DPPA). Contact the BMV for record request procedures.

Enforcement

Indiana State Police, 100 N. Senate Ave., Indianapolis, IN 46204. Operating an unregistered vehicle or driving without insurance are violations subject to fines, license suspension, and reinstatement fees.
