Title & Proof of Ownership
All motor vehicles, trailers, motorboats, and ATVs must be titled in Kentucky.
Exempt from Titling
U.S. government vehicles, vehicles moved solely by animal power, implements of husbandry, special mobile equipment, self-propelled wheelchairs or invalid tricycles, pole trailers, mopeds, electric low-speed scooters, snowmobiles, and documented vessels.
Manufactured Homes
One title is issued regardless of the number of units. Manufactured homes permanently attached to real estate may be converted to real property — title must be surrendered along with an Affidavit of Conversion to Real Estate and fee (fees vary by county).

Application for Title
The application on the back of the Kentucky title is used to transfer vehicle ownership. If no Kentucky title exists, an Application for Kentucky Certificate of Title/Registration (TC 96-182 or TC 96-184 for boats) is made to the County Clerk in the purchaser's county of residence or county where the dealer is located.

Additional fees apply if the lien is to be recorded (see Lien Law section) or if the application is prepared and notarized by the County Clerk. Allow six weeks to receive title. Speed titles are mailed the following business day or available for pickup within 48 hours (processing times may vary by county).
KyELT System
Kentucky is implementing an electronic title application and registration system (KyELT) that allows participating dealers and lienholders to electronically file required forms and signatures in lieu of the paper title application process. See the Lien Law section for further details.
Electronic Signatures
Accepted when an inscription of the software used to e-sign the document is visible next to the signature. Dealers must get pre-approval prior to submitting e-signatures to verify compliance. Once KyELT is fully implemented, electronic signatures and electronic notaries may be accepted through the system.
Proof of Ownership
New Vehicles
Manufacturer's Certificate of Origin or Statement of Origin. If the Total Consideration portion of the application for title is not used, a window sticker or dealer invoice showing purchase price is required.
Used Vehicles
Certificate of Title.
Non-Title Issuing Jurisdiction
Valid Registration Certificate and notarized bill of sale.
Government Surplus Vehicles
U.S. Government Certificate to Obtain Title to a Vehicle (SF97-1). A Military Surplus Vehicle Inspection (TC 96-344) must be completed by a certified motor vehicle inspector certifying the vehicle is roadworthy.
Foreign Vehicles
Foreign ownership documents plus EPA and DOT bond release letters with all attachments and a receipt or certificate from the U.S. Department of Treasury showing all gas guzzler taxes have been paid. English translation by affidavit of a competent translator is required on documents in a foreign language. NHTSA HS-7 or CBP 7501 required for vehicles from Canada, Germany, or Switzerland unless VIN begins with a 1 or the vehicle is more than 25 years old. DD 430 required for military personnel in lieu of customs paperwork.
Surrender of Proof of Ownership: Required. Title is returned to issuing state. Kentucky provides data to and inquiries NMVTIS prior to issuing titles.
Special Titles & Title Brands
Notarization Requirements
Kentucky requires notarization on key titling documents. Failure to have documents properly notarized will result in rejection of the title application.
- Surrender title or MCO/MSO: The assignment on the surrender title (out-of-state or Kentucky title being signed over) or the Manufacturer's Certificate/Statement of Origin (MCO/MSO) must be notarized.
- Kentucky title and registration forms: Most Kentucky title and registration application forms require notarized signatures, including the Application for Kentucky Certificate of Title/Registration (TC 96-182), Affidavit of Total Consideration (71A100), odometer disclosure statements, and powers of attorney.
If documents are notarized by the County Clerk, additional notary fees may apply. Electronic notarization may be accepted through the KyELT system once fully implemented.
Classic Project Title
Issued to vehicles 25 or more years old that are not roadworthy, have not had a Kentucky title, and have not been previously branded. May be updated to a regular title and eligible for registration once the vehicle is restored.
Title Brands
Brands are indicated with an asterisk (*) before and after the brand on the title. Out-of-state brands are carried forward onto Kentucky titles.
Nonrepairable titles are red. Rebuilt titles are red and issued with a brand of rebuilt, water damage, or hail damage.
Stolen Vehicle
If an insurance company becomes the lawful owner of a stolen vehicle, the insurer must apply for title in the company's name; however, a title will not be printed for a vehicle reported to NCIC as stolen. If recovered, a title will be issued upon receipt of a letter of clearance from the Kentucky State Police and verification on insurance company letterhead that the vehicle is a theft recovery with a description of damage. If the vehicle meets salvage requirements, a salvage certificate of title must be applied for.
Salvage Vehicle
Any motor vehicle with damages exceeding 75% of the retail value. An Application for Kentucky Certificate of Title/Registration (TC 96-182) with the Salvage box checked must be submitted within 15 days of receipt of all necessary paperwork along with the assigned title and a Lien Termination Statement.
When a salvage vehicle is transferred to the insurer, notarization is not required on the title, any power of attorney, odometer disclosure statement, or the application for salvage title. Salvage titles are red when the vehicle was previously branded "unrebuildable," "junk," or a similar classification from another state. A registration for highway use will not be issued while a salvage title is in force.
Rebuilt Vehicle
A Rebuilt Title Packet may be obtained from a County Clerk. If a salvage vehicle is made roadworthy, it must pass a Sheriff's Inspection. Required documents include:
- Affidavit of Motor Vehicle Assembled from Wrecked or Salvaged Motor Vehicles (TC 96-215)
- Application for title with properly assigned salvage title
- Notarized Labor Statement (TC 96-353)
- Receipts for parts purchased
- Lien Termination Statement for any liens
- Pencil tracings of frame and motor numbers (motorcycles)
Owner must apply for a rebuilt title and register the vehicle within 60 days of approval. Homemade boats must also go through the rebuilt vehicle process. Contact Rebuilt Support Section at 502.564.1257 for additional information.
Junked / Destroyed Vehicle
Vehicles damaged beyond resale value may be junked. Submit an Application to Junk a Vehicle Title (TC 96-351) with the title and a $1.00 fee to the County Clerk. Title must be clear of all liens and property taxes must be paid in full.
The title to any vehicle destroyed to the extent that repair cost exceeds retail value, or from which two or more VIN-bearing parts have been removed, must be surrendered for cancellation within 10 business days. No fee.
Title Only
Issued. An Affidavit of Nonhighway Use (72A007) must be submitted with the application for title.
Abandoned Vehicle
If ownership can be determined, the owner will be notified by mail of the removal and towing/storage charges. See Towing and Storage Lien in the Lien Law section.
Odometer Disclosure
Required upon transfer of title. Forms TC 96-5, TC 96-4 (leased vehicles), or TC 96-336 (Limited POA) may be used. Exempt: model year 2010 or older, trailers, vehicles without odometers, and trucks over 16,000 lbs. GVWR.
VIN Inspection
All vehicles brought into Kentucky from out of state or country must have a Sheriff's Inspection. Fees: $5.00 onsite, $15.00 offsite. Residents temporarily out of state (1–9 months) may use form TC 96-229. Military personnel are exempt from the 1–9 month rule.
Lien Law
Lien is noted on the application for title or on the back of the Kentucky title. Secured party must submit a Title Lien Statement (TC 96-187) to the County Clerk in the purchaser's county of residence. No more than two liens may be recorded on a Kentucky title.

Filing Requirements
If a Title Lien Statement and required fees are not submitted at the time of application for title, a title will not be issued until the lien has been noted and fees paid — or in 30 days, whichever occurs first. The security interest is deemed perfected at the time it attaches if documents and fees are submitted within 30 days; otherwise, perfected at the time of submission.
Beginning January 1, 2025: The Title Lien Statement and required fees may be submitted to any County Clerk. If the application indicates a pending lien but no Title Lien Statement accompanies it, the County Clerk will note the pending lien and a title will not be issued until the statement and fees are submitted, or in 30 days.
Lien Expiration
Liens remain effective for 10 years; 30 years for manufactured homes. A continuation statement filed within six months of expiration extends for five additional years. Succeeding continuation statements may be filed.
Responsible Party
The lienholder is responsible for filing liens on vehicles; however, a dealer may act as an agent for the lender. Assignment of lien follows the same procedures as any other addition or removal of a lien.
Release of Lien
A Title Lien Statement (TC 96-187) or a termination statement must be completed by the secured party and submitted to the County Clerk in which the debtor resides no later than 10 days from receipt of payment to avoid penalty. Discharge is by notation on the title and entry into KAVIS. Beginning January 1, 2025, termination statements may be submitted to any County Clerk.
Mechanic's Lien
Vehicle must be in mechanic's possession and reasonable agreed charges must be past due more than 30 days. A proposed sale notice must be sent by certified mail to the owner and any lienholder at least 10 days prior to sale. An advertisement must be published in a local newspaper once a week for three consecutive weeks. A mechanic's lien is superior to a perfected security interest on the title.
The purchaser must submit an Affidavit of Motor Vehicle Sale (TC 96-159), a bill of sale from the repair company on company letterhead, an application for title, an affidavit of publication from the newspaper, and certified mail receipts and return receipts.
Towing & Storage Lien
Subject to prior recorded liens.
Voluntary Tow
If fees have not been paid and a properly endorsed title and lien satisfactions have not been provided within 45 days, a title clear of all liens may be applied for. If a prior lien exists, a legal notice must be published in a newspaper of statewide circulation at least twice in a 7-day period at least two weeks prior to presenting the affidavit to the County Clerk.
Involuntary Tow
The towing business must notify the registered owner by certified mail within 10 business days. If charges have not been paid after 45 days, the vehicle may be sold. A notice of sale must be sent by certified mail to the owner and any lienholder at least 10 days prior to sale. If a prior recorded lien exists, an advertisement must be published once a week for three consecutive weeks.
A Request by Towing & Storage Companies & Lien Holders for Motor Vehicle or Boat Records (TC 96-16T) may be used to obtain ownership information. Fee is $3.00 per record.
Self-Storage Lien
When an occupant is in default for more than 45 days, the operator may sell the vehicle. Occupant must be notified by mail or email, and a second notice must be sent by verified mail or email that the vehicle will be sold if not reclaimed within 14 days. An advertisement must be placed at least three days prior to sale. Remaining proceeds are held for other recorded lienholders who present claims within 60 days, then delivered to the occupant. If in default for more than 60 days, the operator may have the vehicle towed or removed in lieu of sale. A notarized Kentucky Self-Service Storage Act (TC 96-179) must be submitted with an application for title.
UCC Filings
Liens on non-titled vehicles are filed through the Office of the Secretary of State, UCC Division, 700 Capital Avenue, Suite 158, PO Box 718, Frankfort, KY 40601, 502.564.3490. Acknowledgement of all UCC filings will be sent by email when an email address is provided.
Lien Records & Title Mailing
Lien records are on file in Kentucky's Automated Vehicle Information System (KAVIS). Titles with a lien are mailed to the registered owner. The lienholder receives a certified copy of the Title Lien Statement.
KyELT System
Kentucky is implementing an electronic title application and registration system allowing approved entities (licensed motor vehicle dealers, financial institutions, fleet owners, or retailers of manufactured homes or RVs) to electronically file required forms and signatures. There is no electronic title component — titles will be printed and mailed to registered owners.

- Must contract with a third-party provider; online transaction fee may be charged
- Any fee charged to the purchaser must be listed separately on the buyer's order as "on-line system filing fee"
Transfer of Title
Transfer is accomplished by notarized assignment of title. Title must be applied for within 15 days of purchase to avoid penalty. If there is a lien on the title, a lien release is required prior to transfer. The owner must notify the County Clerk when a vehicle has been sold or moved out of state. License plates must be surrendered at time of transfer.
Dealer Requirements
Kentucky licensed dealers must submit a Notice to County Clerk of Vehicle Acquisition (TC 96-183) within 15 days of vehicle acquisition, unless titling in dealer's name. If transferring to a nonresident, an Affidavit of Incomplete Transfer (TC 96-3) should be submitted.
Damage Disclosure Statement
Sellers must make written disclosure of all damages of which they have direct knowledge, all damages resulting in repairs (other than wheels, tires, or glass) exceeding $2,000, or all damages occurring while in the seller's possession prior to delivery. Purchaser's signature acknowledging disclosure is required. Title Brand Disclosure section must be filled out on the application for title. A title brand must be disclosed to a prospective purchaser prior to sale.
Add/Remove a Party
Same procedures as any other transfer; however, new plates are not required. To remove a party, written permission from the lienholder is required, if applicable.
Notarization
Required for title transfer. Additional fees apply if documents are notarized by the County Clerk.
Tenancy in Common ("and")
Names joined by "and" or no conjunction. Both signatures are required to transfer ownership.
Joint Tenancy ("or")
Names joined by "or". Only one signature is required to transfer ownership.
Transfer Upon Death
If all owners are deceased and there is a Will, the Will must be probated and the executor may assign the title. Executor papers must be submitted. If there is no Will, an Order to Dispense with Administration must be obtained from a local Circuit Judge.
If the title is issued in joint tenancy and one party is deceased, the title may be transferred to the survivor upon submission of a death certificate, the title, and appropriate fees.
Transfer on Death (TOD): Kentucky does not allow beneficiaries to be placed on the title.
Power of Attorney
A generic POA may be used. A Limited Power of Attorney to Transfer Ownership & Disclose Mileage (TC 96-336) may also be used. Two parties may not be placed on the POA. Electronic signatures are allowed.
Limited Assignment Space
When an out-of-state title has no reassignment space, a dealer may reassign on a Kentucky Dealer Reassignment Form (TC 96-180A). Only one Kentucky reassignment can be attached to any title. Anyone other than a dealer must apply for title in their name prior to transfer.
Repossession
Upon default in the terms of a security agreement, the lienholder may take possession of the vehicle without judicial process, if it proceeds without a breach of the peace.
Requirements
- Lienholder must surrender the vehicle license plate if not retained by the owner
- Submit proof of notification to all interested parties and a termination statement (or proof that one has been filed) within 15 days of disposition
- To transfer title: submit an Affidavit Supporting Repossession and Disposition of a Vehicle (TC 96-192), an application for title, and a copy of the security agreement to the County Clerk where the lien is filed
- Title fee applies
- If the new title is in the name of the lienholder, use tax does not apply
Out-of-state lienholders must follow Kentucky guidelines when repossessing a vehicle in Kentucky.
Registration
All vehicles used on the highways must be registered. All motorboats must be registered. New residents must register their vehicles within 15 days of establishing residency.
Exempt from Registration
Snowmobiles, ATVs, OHVs, boats with trolling motors, boat trailers, some farm trailers, some noncommercial trailers, and mopeds.
Application for Registration
Submitted to the County Clerk in county of residence. If the owner is other than an individual residing in Kentucky, the vehicle must be registered with the County Clerk of either the county in which it is principally operated or the county where the owning entity is located. Registration must be carried in the vehicle.

Renewal
Reminders are sent to registered owners. Renewal may be made in person, at drop boxes, by mail, or online. Renewal by phone is available in some counties. A $2.00 fee covers mailing costs and a service fee is charged for online renewal. Credit/debit transactions are subject to a processing fee.

Nonresidents
Nonresidents with vehicles properly registered in their home state are exempt from Kentucky registration for the same period granted to nonresident owners of the home state. Properly registered nonresident boats may be used for up to 60 consecutive days without registering in Kentucky.
Planned Non-Operation
Vehicle does not have to be registered; however, personal property taxes must be paid annually. An Affidavit of Non-Highway Use (72A007) must be submitted annually. License plates must be surrendered to the County Clerk prior to cancelling insurance.
Military Registration
Military personnel stationed outside the U.S. must renew registrations within 30 days of return to Kentucky to avoid penalties and interest. Nonresident military personnel stationed in Kentucky are exempt from motor vehicle usage tax if the vehicle is purchased from a licensed Kentucky dealer (attach Leave and Earnings Statement to form 71A101).
Nonresident active-duty military stationed in Kentucky are exempt from Kentucky property/ad valorem tax. Disabled veterans issued a motor vehicle by the VA or declared 100% combat-related disabled are entitled to free license plates (form TC 96-217).
Plates
One plate issued; two plates for historic vehicles. Plate remains with vehicle. Personalized and special plates may be transferred to another vehicle through the County Clerk.
Dealer & Manufacturer Plates
Dealer plates: $25.00 for certificate + one plate; $15.00 each additional. May be used for demonstration, delivery, and pleasure. Manufacturer plates: same fee structure. Out-of-state plates may be used on a reciprocal basis.
Taxes
Motor Vehicle Usage Tax
6.0% of the retail price
Collected on the sale or transfer of motor vehicles to be titled or registered in Kentucky, unless exempt. Minimum tax $6.00. Credit is allowed for trade-in.
Motor vehicles are taxed on the selling price as attested to on a notarized Affidavit of Total Consideration Given for a Motor Vehicle (71A100) or Application for Kentucky Certificate of Title/Registration (TC 96-182). If the affidavit is incomplete or not available at time of registration:
- New vehicles: 90% of MSRP
- New trucks over 10,000 lbs. gross weight: 81% of MSRP
- Used vehicles: clean retail or clean trade-in value
- Current model year used vehicles (no published average retail): 85% of MSRP
Usage Tax Exemptions
- Government or public charities and educational institutions (not for profit)
- Vehicles sold to licensed dealers for resale
- Commercial vehicles (excluding passenger vehicles seating 9 or less) owned by nonresidents in interstate commerce based in another state
- Transfers between immediate family
- Transfers by Will, court order, or inheritance (if titled in KY July 1, 2005 or later, or previously registered in KY)
- Vehicles repossessed by the lienholder and held for resale
- Vehicles transferred to an insurance company for settlement and held for resale or junked
- Motor carriers operating under a charter bus certificate
- Motor vehicles and farm trucks and any towed unit 44,001 lbs. or more declared GVW
Form 71A101 is used to apply for tax exemption for transfers to immediate family and military personnel.

Sales / Use Tax
6.0% of gross receipts or purchase price
Collected on sales of boats, mopeds, ATVs, manufactured homes, mobile homes, camper trailers, boat trailers, utility trailers, and other trailers (except trailers/semitrailers designed to be drawn by motor trucks with load capacity over 1,000 lbs.). Motor vehicles subject to usage tax are exempt from sales/use tax.
Credit is allowed for taxes paid to another state if that state grants credit for sales taxes paid in Kentucky. An Out-of-State Purchase-Use Tax Affidavit is required for trailers, boats, manufactured homes, ATVs, or other tangible personal property purchased out of state for title or first-time registration in Kentucky.
Remote sellers with 200+ transactions or $100,000+ in gross receipts from sales into Kentucky must register, collect, and remit Kentucky sales and use tax.
Sales/Use Tax Exemptions
- Nonresidents: Certificate of Exemption – Out-of-State Delivery (51A154) submitted within 30 days of sale
- Farm/agricultural/aquacultural: Farm Exemption Certificate (51A158) with agriculture exemption number
- Occasional sales
- Vehicles held for resale with a Resale Certificate (51A105)
- Nonprofit educational, charitable, or religious institutions with Purchase Exemption Certificate (51A126)
- Ships and vessels used principally in transportation of property or conveyance of persons for hire
Property / Ad Valorem Tax
Assessed on motor vehicles, recreational vehicles, mobile homes, trailers, semitrailers, and motorboats as of January 1 each year. The owner on January 1 is responsible for paying property taxes for that year. Payment is made to the County Clerk where the vehicle is registered.
Late Payment Penalties
- Within 30 days of becoming delinquent: 3.0% penalty (waived if paid within 5 days of delinquency)
- After 30 days: 10% penalty plus 15.0% annual interest from the date of delinquency
- Filing and release of each lien from tax delinquency: $2.00 fee added to account
An application for title and registration will not be processed when there are delinquent property taxes. When any ad valorem tax becomes delinquent, the state and any other taxing district shall have a lien on all motor vehicles owned or acquired by the person who owned the vehicle at the time the tax liability arose.
Special Classifications
Trucks, tractors, and buses operated on a route partly within and partly outside Kentucky are subject to an annual fee in lieu of ad valorem property tax. Semitrailers and trailers with a load capacity over 1,000 lbs. used on such routes are exempt from ad valorem tax.
Mobile homes, manufactured homes, and recreational vehicles are classified as real property if the wheels or mobile parts have been removed and the unit rests on a permanent, fixed foundation.

Federal Heavy Vehicle Use Tax
A Heavy Highway Vehicle Use Tax Return (IRS Form 2290) must be submitted to the County Clerk at time of renewal for vehicles 55,000 lbs. and over. The County Clerk will not transfer the registration of any vehicle against which taxes have not been paid.

Limited tags (urban, forest products, concrete hauling) are issued at 75% of the above fees. Farm trucks 38,000 lbs. or less: $21.00. Farm trucks over 38,000 lbs.: 40% of the above fees. Fees are increased by 50% if the vehicle is not equipped wholly with pneumatic tires.

Reduction of Fees & Refunds
Motorcycles, trailers, boats purchased from registered dealers, and vehicles brought in from other states are prorated monthly. Commercial trucks and trailers are prorated monthly.
Vehicles totally destroyed by fire or accident may apply for a refund of the license fee (form TC 96-171). Commercial vehicles over 18,000 lbs. transferred to a new owner are granted a refund of the unused portion (form TC 96-170). Overpayment of motor vehicle usage tax may be refunded if requested within four years. Property tax refund requests must be filed within two years.

Lease Information
Same procedures apply to leased vehicles as privately owned vehicles. Leased vehicles are titled in the name of the lessor. Registration shows both lessor and lessee names. A copy of the lease agreement is required to be carried in the vehicle. If someone other than the owner/applicant is signing documents, a notarized Power of Attorney signed by both parties is required.
A Kentucky IRP Apportioned Operational Lease Agreement (TC 95-641) must be signed by the lessor and lessee for title and registration of a leased apportioned vehicle.
Persons engaged in rental or leasing of motor vehicles to retail customers must obtain a U-Drive-It certificate. Application fee: $250.00 (form TC 95-16). Motor vehicle usage tax may be paid on the retail price or on gross rental/lease charges. The lessor is responsible for property tax on leased vehicles; however, tax may be passed on to the lessee.

Dealers must have $100,000/$300,000/$50,000 for vehicles to be operated and must provide no-fault. Proof of insurance is required at time of registration. Failure to maintain insurance may result in revocation of registration, a fine up to $1,000, and up to 90 days in jail.
Safety Inspection
Motor vehicles converted to natural gas must be inspected at time of conversion, every three years or 36,000 miles, and following any collision involving speeds of 5 mph or more. Emission inspection is not required.
Records
Filed by license plate number, VIN, or title number. Title records retained for five years. Commercial requests: form TC 96-16A, $3.00 per record. Government requests: form TC 96-16G. OVIS provides online access to vehicle data ($75.00 annual subscription per 10 users).
