Title & Proof of Ownership

Title issued to all motor vehicles and watercraft except snowmobiles, ATVs, ORVs, electric-assisted bicycles, trailers with a gross weight of 4,000 lbs. or less*, trailers designed primarily for agricultural purposes with a gross weight of less than 10,000 lbs., documented vessels, kayaks, canoes, seaplanes, rowing shells, lifeboats, watercraft with a model year of 1979 and older, vehicles moved solely by animal power, implements of husbandry, special mobile equipment, self-propelled wheelchairs or invalid tricycles, and vehicles owned by the U.S. Government.

* Unless there is a lien or a title has been issued in any state.

Manufactured Homes

Manufactured homes are titled unless affixed to real property — one title issued. The MCO or title must be surrendered for cancellation when affixed to real property and a notice of surrender is issued to the owner. A new title or reissue of a previously surrendered title may be issued when home is unaffixed from realty.

Application for Title

Application to Title/Register a Vehicle (PS2000) is submitted to a local Deputy Registrar or by mail to Driver & Vehicle Services in St. Paul. Title fee is $8.25 plus $3.50 Public Safety Vehicle fee, $2.25 technology surcharge, $10.00 transfer tax, and $12.00 filing fee. An additional $2.00 fee is due for each security interest. Allow 10 weeks processing. Expedited Title (three business days) is available in limited circumstances for an additional $20.00 fee. Title status may be checked online. Make checks payable to Driver and Vehicle Services.

Transfer tax is not collected on vehicles less than 1,000 lbs., transfers from joint to single ownership, transfers for resale purposes, transfers to a government entity, or when the owner's name is listed on a foreign state title or registration card.

Dealers & Electronic Services

Minnesota dealers, fleet companies, motor carriers, and electronic lienholders use e-Services for Business to conduct business with DPS-DVS. Dealers may search motor vehicle records, submit transactions, file title notifications, and manage dealer licenses and plates. Electronic vehicle title and registration (EVTR) services allow licensed Minnesota dealers to work with a DPS-DVS-approved vendor to submit title requests through MNDRIVE.

Watercraft Titling

Watercraft are titled through the Department of Natural Resources. A Watercraft Title & Registration Application must be submitted with a title fee of $15.00 plus $7.00 issuing fee; or $10.00 plus $7.00 issuing fee for title transfer. Fee is $10.00 plus $7.00 issuing fee to add a lien.

Electronic Signatures

Supporting documents used to transfer ownership of a salvage vehicle do not require a notarized signature and may be signed electronically. Electronic signatures are not accepted on any other type of title transfer.

Non-Title Issuing Jurisdiction

Minnesota Registration Card or bill of sale that includes complete vehicle description. A foreign state registration is not acceptable proof of ownership and vehicle may be subject to bonding.

Government Surplus Vehicles

U.S. Government Certificate to Obtain Title to a Vehicle (SF97-1). Titles will not be issued to vehicles not manufactured in compliance with federal emission standards in force at the time of manufacture or federal safety standards unless proof that the vehicle was not brought into the U.S. from outside the country is furnished. If brought into the U.S. from a foreign country, Foreign Vehicles procedures must be followed.

Foreign Vehicles

Foreign ownership documents plus bond release letters from EPA and DOT and a receipt or certificate from the U.S. Department of Treasury showing any gas-guzzler taxes have been paid. A notarized English translation required for documents written in a foreign language. Foreign vehicles are issued a Distinctive Title.

Surrender of Proof of Ownership: Required. Minnesota provides data to and inquiries NMVTIS prior to issuing titles.

Insufficient Evidence of Ownership

When DVS is not satisfied as to the ownership of a vehicle or the existence of security interests therein, the vehicle may be issued a Conditional Registration; however, DVS will either withhold issuance of title until satisfactory documents are presented or require the applicant to file a bond.

Odometer Disclosure

Required upon transfer of ownership. Vehicles with a model year of 2010 or older, trailers and other vehicles without odometer devices, and trucks over 16,000 lbs. GVWR are exempt.

VIN Inspection

Required on reconstructed and salvage vehicles. May be required on bonded vehicles.

Special Titles

Distinctive Certificate of Title

Unless a bond is filed, a distinctive title will be issued for a vehicle last previously registered in another state or country that does not require secured parties be named on the title to perfect their security interests. The title contains the legend "This Vehicle May be Subject to an Undisclosed Lien." If no notice of security interest is received within four months, a clear title may be issued upon application.

Bonded Title

When there is no existing vehicle ownership record in Minnesota or any other state or country, a Statement of Facts (PS2002) must be submitted with an application for title, bill of sale, a statement of protection, photos showing all sides of the vehicle, a photo or clear tracing of the VIN, and appropriate fees and taxes. DVS will notify applicant if vehicle requires inspection and/or bonding. Bond must be in an amount equal to 1½ times the value of the vehicle. Unless there is an action to recover the bond, the bond may expire after three years. A title with the notation "bond" is a negotiable (transferable) title. If applicant is unable to obtain a bonded title, a court order may be required.

Salvage Vehicle

A vehicle for which an insurance company has declared a total loss or paid a total loss claim or that has been involved in a collision or other event in which the cost of repairs exceeds 80% of the value of the vehicle before the damage occurred. When an insurer acquires ownership of a late-model (six model years old and newer) or high-value ($9,000 or more prior to damage) vehicle through payment of damages, the insurer must immediately apply for a title bearing a Salvage brand. Salvage titles are clearly marked "Salvage-Must be Inspected." Flood damaged vehicle titles are permanently branded "Flood."

Prior Salvage / Rebuilt / Reconstructed

To remove "salvage" from a title, vehicle must pass a DVS salvage inspection. At time of inspection, the salvage title must be provided with a Declaration of Reconstruction (PS2015) and original receipts for any major parts replaced. After successful completion, documents must be submitted with a $35.00 inspection fee and $12.00 filing fee. Title is branded "Prior Salvage." Motorcycles are exempt from prior salvage branding; however, if assembled with new aftermarket parts, a title with an Assembled notation is issued.

Junk Vehicle

Any vehicle that is extensively damaged, apparently inoperable, without valid registration, and has an approximate fair market value equal only to the value of scrap in it. Minnesota does not title junked vehicles; however, a junking certificate is issued upon surrender of title. A new title will not be issued to any vehicle with a title containing the words junked, non-repairable, scrapped, dismantled, or destroyed.

Abandoned Vehicle

A motor vehicle that has remained illegally on any property without consent of the person in control of the property. Any person who abandons a motor vehicle is guilty of a misdemeanor. An impounded vehicle determined to be a junk vehicle or an abandoned vehicle is eligible for disposal or sale 45 days after notice to the owner (15 days if impounded by the cities of Minneapolis or St. Paul).

Title Only

Issued to dealers or vehicles exempt registration. Dealer must pay one month's registration tax and note "held for resale" in the sales tax declaration area of the title.

Stolen Vehicle

A recovered intact vehicle that was verified by the insurer to be stolen and declared a total loss and subsequently recovered with damage not in excess of 80% of its value does not require a salvage or prior salvage title and may be issued a clear title.

Title Brands

Brands are shown on the Minnesota title in a clear and conspicuous manner in a format different from all other writing on the title. Foreign brands are forwarded onto Minnesota titles. A commercial vehicle with a GVWR of 16,000 lbs. or more is exempt from branding unless reconstructed.

Duplicate & Corrected Titles

An Application for Duplicate Title (PS2067A) must be submitted to the central office of DVS or Deputy Registrar. Title fee is $7.25 plus $2.25 technology surcharge, $2.00 per lien if applicable, and $12.00 filing fee. Duplicate title contains the legend "This Duplicate Certificate of Title may be subject to the rights of a person under the original certificate." No fee if departmental error. Allow 14 days to receive duplicate title. A corrected title requires return of the title and an Application for Corrected Title/Odometer (PS2025). Fee is $8.25 plus $2.25 technology surcharge and $12.00 filing fee. Expedited processing available for $20.00 fee. Fee is $4.00 for watercraft duplicate title or $10.00 for watercraft corrected title, plus $7.00 issuing fee.

Lien Law

To record a lien on a newly purchased vehicle, the secured party's information is entered on the Application to Title/Register a Vehicle (PS2000). Additional secured parties are added on a Notification of Assignment, Release, or Grant of Secured Interest (PS2017). Fee is $2.00 to record each security interest, plus $12.00 filing fee. A Minnesota Auto Dealer Statement of Perfection to a Secured Party must be provided to the secured party and a copy delivered to DVS. Security interest is perfected as of the time of delivery. The names of any secured parties, and the address of the first secured party, are listed on the title in the order of priority.

Manufactured Homes

When a manufactured home is encumbered by a security interest as well as a mortgage covering both the home and land, the title need not be surrendered if a Manufactured Home Notice of Security Interest (PS2726) is submitted to the County Recorder or Deputy Registrar for the county in which the real property is located.

Lien Expiration

A security interest perfected on a passenger automobile or manufactured home may be canceled seven years from the perfection date if the lien has been paid in full or the lien has been abandoned and the owner is unable to locate the lienholder to obtain a release. A letter must be sent to the lienholder by certified mail, return receipt requested. A lien release may be required if vehicle is sold to a nonresident, as other states may not honor Minnesota's 7-year policy.

Assignment of Lien

Secured party remains liable for any obligations as the secured party until the assignee is named as the secured party on the title. The title may be endorsed or issued with the assignee named as secured party upon submission of the title, a Notification of Assignment, Release, or Grant of Secured Interest (PS2017), and a fee of $1.00 plus $12.00 filing fee. Fee is $1.00 plus $7.00 filing fee for watercraft.

Responsible Party for Filing

Dealers are responsible for filing liens on vehicles sold through the dealership. The owner is responsible for filing liens on private party sales.

Mechanic's Lien

Whoever stores, cares for, or contributes to the preservation or enhancement of value of a vehicle at the request of the owner has a lien. Possession may be retained until lien is discharged. Vehicle may be sold if lien is not paid within 90 days after it becomes due. Written notice must be sent to all secured parties at least 45 days prior to sale.

Release of Lien

A lien release must be sent to the next secured party, or if none, to the owner within 15 days of satisfaction; seven days if satisfied by a licensed dealer. The owner must surrender the title and release with a $12.00 filing fee to DVS to release the secured party's rights on the title or have a new title issued. A notarized Notification of Assignment, Release or Grant of Secured Interest (PS2017) may be used.

UCC Filings

Not adopted for motor vehicles. Liens on manufactured homes may be filed through the Minnesota Secretary of State, Uniform Commercial Code, 332 Minnesota Street, Suite N201, Saint Paul, MN 55101, 877.551.6767, [email protected]. Online filing available.

Electronic Liens (e-Liens)

Financial agencies may register with DVS to become e-lienholders. E-lienholders may mark a lien as electronic in MNDRIVE. Liens may be electronically released via MNDRIVE e-Services for Business which instantly updates the vehicle account. The e-lienholder may notify the owner that the lien has been released and the title may be updated by visiting a Deputy Registrar. Lien Card is not sent to the owner and is not required to release the lien on the title.

Transfer of Title

Transfer is accomplished by assignment of title. The Seller's Notice of Sale section of the Minnesota title must be filed within 10 days of sale, donation, or removal from Minnesota, unless sold to a Minnesota dealer. Notice of Sale may be made online. If a lien is shown on the title, a release must accompany the transfer. Purchaser must apply for title within 10 business days of assignment to avoid a $2.00 penalty. If the title is not transferred within 30 days, a $10.00 fee is due to reinstate registration. There is a $3.00 transfer fee to transfer ownership of a non-titled vehicle.

If the vehicle is a motorcycle, the engine number must be recorded on the face of the title.

Add/Remove a Party

Same procedures are followed as any other transfer. Transfers from joint to single ownership are exempt from transfer tax and sales tax.

Damage Disclosure

Motor vehicle dealers must provide a written and verbal disclosure of any prior vehicle damage, the existence or requirement of any title brand, or if the vehicle has been submerged or flooded. Vehicles six years old or older and commercial vehicles 26,000 lbs. GVW or more are exempt damage disclosure. Verbal disclosure not required for online sales.

Tenancy in Common

No conjunction is used between names. All owners must sign upon transfer. If one of the parties is deceased, the administrator/executor of estate acts in place of the deceased.

Joint Tenancy

Names joined by the conjunction "or" indicate right of survivorship. All owners must sign upon transfer. If one of the parties is deceased, the survivor may transfer vehicle by submitting the title, proof of death, and appropriate fees.

Transfer on Death (TOD)

A notarized Application for Transfer-on-Death Beneficiary (PS2004) must be submitted with the title or application for title. The owner(s) names on the title are followed by "transfer on death to (name)". Ownership of the vehicle transfers to the beneficiary upon death of the owner or last survivor of joint ownership with rights of survivorship, subject to the rights of secured parties. Certified death record must be submitted.

Notarization

Not required.

Power of Attorney

A Minnesota Secure Power of Attorney and Disclosure Form may only be used if the title to a trade-in vehicle has been lost. If the sale is for a vehicle not subject to disclosure, a generic Power of Attorney is accepted.

Limited Assignment Space

When there is no further assignment space available, a licensed dealer may attach a Minnesota Supplemental Dealer Reassignment form to the title. The form may be used as a reassignment supplement on a foreign state title, provided a Minnesota licensed dealer appears as a seller or purchaser on the form. More than one form may accompany the title.

Repossession

Upon default in the terms of a security agreement, the secured party may take possession of the vehicle without judicial process, if it proceeds without a breach of the peace. If the secured party is in possession of the title, they need not apply for a title in their name but must submit a Dealer Purchase Receipt (PS2009) within 48 hours of repossession.

Title Unavailable

If secured party is unable to obtain the title from the registered owner or if the owner failed to transfer ownership and is not shown on the title, a title must be issued in the secured party's name prior to transfer. If repossessor chooses to title in their name, the title must be submitted with a notarized Affidavit of Repossession/Title Application (PS2024) or Affidavit of Repossession/Title Application for watercraft, the title fee, PSV fee, and filing fee. If the lienholder is anyone other than a lending institution, dealer, or the prior owner, sales tax is due. If the lienholder elects to use the vehicle, vehicle must be titled in lienholder's name and sales tax is due. All unperfected liens require a court order.

Out-of-State Repossession

A Minnesota repossession form is not accepted with a foreign state title. The lienholder must provide the documents required by the jurisdiction that issued the title.

Registration

All vehicles, trailers, ATVs, OHVs, OHMs, snowmobiles, and watercraft are registered except manufactured homes, park trailers, non-motorized watercraft 10 feet or less, carriers of certain equipment, implements of husbandry, tractors used solely for agricultural purposes, farm trailers less than 10,000 lbs. GVW, fertilizer trailers, special mobile equipment, and official government and municipal vehicles. New residents must register their vehicles within 60 days of establishing residency.

Application for Registration

Made to any Deputy Registrar. Registration Card or Cab Card must be carried in commercial vehicles. ATVs, OHVs, OHMs, snowmobiles, and watercraft are registered through the Department of Natural Resources or Deputy Registrar. Used OHVs purchased in Minnesota must be registered within 15 days for ATVs and OHMs; 30 days for ORVs.

Nonresidents

Properly registered nonresident vehicles may be operated in Minnesota without obtaining Minnesota registration to the extent that under the laws of the state of residence like exemptions are granted to motor vehicles registered in Minnesota. Licensed watercraft from out of state operating on Minnesota waters for more than 90 consecutive days must register in Minnesota.

Planned Non-Operation

Vehicles not being operated on the public roadway are not required to be registered. Plates do not have to be surrendered. There is no penalty for delayed registration, but when the registration is renewed, tax must be paid from the month it became due.

Plates

Two plates issued; one plate for mopeds, motorcycles, trailers, dealers, truck-tractors, 1972 or earlier model year vehicles, pioneer, classic, collector, and street rods. A lifetime adhesive sticker is issued to utility trailers 3,000 lbs. GVW or less. Plates remain with vehicle upon transfer of title. Plates expire after 10 days have elapsed from the date of transfer unless a transfer has been filed. If vehicle is sold to a nonresident, plates must be removed.

Military Registration

Nonresident military personnel stationed in Minnesota may retain home state registration. Resident military personnel are exempt motor vehicle registration tax during active duty and for 90 days thereafter if the motor vehicle is not operated within Minnesota except while on furlough. Veterans with a 100% total service-connected disability may receive free motor vehicle registration, plates, and title services for up to two vehicles. Beginning July 1, 2024, purchases of motor vehicles by 100% disabled veterans are also exempt from Motor Vehicle Sales Tax.

Motor Vehicle Sales Tax (MVST)

6.875% of the purchase price or fair market value of the vehicle, whichever is higher, unless exempt or vehicle qualifies for an in-lieu tax. Tax is paid to the Deputy Registrar or DVS. Credit is allowed for trade-in of another registered or previously registered motor vehicle titled in owner's name, parent's name, or spouse's name. Credit allowed for taxes paid to another state. New residents are exempt tax if vehicle was titled for at least 60 days in other state. Nonresidents are exempt if vehicle is to be registered in another state.

Exemptions

Exempt are gifts between immediate family members, transfers upon divorce or inheritance, transfers from joint to single ownership, transfers between related companies, sales to nonprofits or exempt agencies, and vehicles sold to tribal members living on a reservation when the sale occurs on the reservation.

In-Lieu Tax

A $10.00 in-lieu tax is assessed on passenger vehicles 10 years old or older when the purchase price and fair market value is less than $3,000.00. A $150.00 in-lieu tax applies to passenger vehicles and fire trucks registered in a collector class.

General Sales Tax (Non-Highway Vehicles)

Vehicles not registered for road use are subject to 6.875% sales tax plus any local or regional taxes. There is a sales tax rate calculator online. Credit is allowed for trade-in. Credit is allowed for taxes paid to another state. Casual sales of OHVs are exempt. The first retail sale or use of a manufactured home in Minnesota for residential use is subject to sales/use tax on 65% of the dealer's cost.

Excise Tax

A $20.00 Vehicle Excise Tax applies to dealer sales of motor vehicles sold in Anoka, Beltrami, Carlton, Carver, Dakota, Goodhue, Hennepin, Kandiyohi, Otter Tail, Ramsey, Rogers, Sauk Centre, Scott, St. Louis, Washington, and Willmar counties and in the cities of Baxter, Brainerd, Clearwater, Hutchinson, Mankato, New Ulm, and Rochester. Fee is collected by the Department of Revenue; however, some cities and counties administer their own tax. Vehicles not licensed for road use and vehicles purchased for resale are exempt.

Property Tax

Assessed on manufactured homes as determined by County Assessor. All personal property taxes must be paid to transfer a manufactured home title.

Federal Heavy Vehicle Use Tax

Motor vehicles with a declared gross weight of 55,000 lbs. or more must provide proof of payment prior to registration.

Registration / Plate Fees

Important Notes

  • In addition to registration tax, there is a maximum $20.00 wheelage tax collected for vehicles kept in participating counties.
  • An $8.00 filing fee is due with each renewal; $12.00 for any other transaction.
  • Deputy Registrars assess a $1.00 surcharge on each transaction for which filing fees are collected.
  • A $2.25 registration technology surcharge applies to registration renewal.
  • A surcharge of $75.00 is imposed on all-electric vehicles in addition to other fees and taxes.
  • Passenger and dealer plates are replaced every seven years. Fee is $15.50 for two plates; $13.50 for single plate.

Passenger Automobile Registration Tax

Tax is determined by the base value and age of the vehicle. Tax is $10.00 plus 1.54% of the MSRP for vehicles initially registered in Minnesota prior to November 16, 2020; or 1.575% of the MSRP for vehicles initially registered on or after November 16, 2020.

Depreciation schedule: 100% for 1st year, 95% for 2nd, 90% for 3rd, 80% for 4th, 70% for 5th, 60% for 6th, 50% for 7th, 40% for 8th, 25% for 9th, 10% for 10th, or $20.00 for the 11th and each succeeding year.

Personalized Plates

$100.00 in addition to regular registration fees plus $12.00 filing fee. No fee for renewal. Plates replaced every seven years. Plates may be transferred.

Plate Transfer Fees

$3.00 conversion fee on all conversions to a different registration class. $5.00 plus $12.00 filing fee to transfer special plates.

Duplicate & Replacement

$15.50 for two plates, $13.50 for one plate, $1.00 for duplicate registration, $1.50 for duplicate validation stickers, plus $12.00 filing fee. $2.50 for trailer lifetime sticker.

General Information

Lease Information

Same forms, fees, and procedures apply to leased vehicles as privately-owned vehicles. A Minnesota-based lessor must have a lessor's license; an out-of-state lessor must have a Minnesota Sales Tax Permit. Title is issued in the name of the lessor. Registration may be issued in the name of lessee. If vehicle is leased for more than 120 days, a Lessee Designation (PS2019) must be completed.

Motor vehicle leases are subject to the 6.875% general sales tax rate plus any local or regional sales tax on the total lease price. Tax must be collected up-front. Short-term motor vehicle rentals (28 days or less) are subject to the 6.875% general sales tax rate plus any local taxes, a 9.2% Motor Vehicle Rental Tax, and a 5.0% Motor Vehicle Rental Fee.

Motor vehicle owners must maintain no fault insurance. Proof of insurance must be carried in the vehicle. Insurance policy details are required when registering or renewing registration.

Emission Inspection

Not required in Minnesota.

Motor Vehicle Safety Inspection

A Minnesota Annual Inspection Decal issued by a certified inspector is required to operate commercial motor vehicles registered in Minnesota and self-propelled special mobile equipment mounted on a commercial motor vehicle chassis. Limousines and special transportation service vehicles must be inspected annually.

Records

Filed by name, title number, VIN, and license plate number. Records maintained seven years. A DVS Records Request (PS2502) must be submitted with a fee of $9.50 for copy of record, $10.50 for certified copy of record, plus $1.00 per printed page for vehicle title history.
